License Agreement
Legal Notice from TogetherSoft Corporation: This is a legal document between you and TogetherSoft Corporation. It is important that you read this document before using the TogetherSoft software. By using the software or in taking such other action as may be referenced in this license agreement, you are agreeing to the terms of this license. If you do not agree with the terms of this license do not install or use the software and return it to TogetherSoft for a refund.
The application program included in this shipment and covered by this license Agreement is Together®, "The Product," which is a product of TogetherSoft Corporation. The full installation of The Product includes third-party software, including free software released by the GNU project of the Free Software Foundation, the use of which is specifically not covered by this Agreement. An electronic copy of each third-party software producer's license agreement is installed to your computer when you install The Product. Your use of all such third-party software is governed by the separate license agreement of the respective producer or vendor of that software.
In this Agreement, "You" or "User" refers to the person or organization that has purchased the right to use and/or has received an edition of The Product.
PLEASE READ THIS NOTICE CAREFULLY
You have purchased the right to use and/or have received an edition of The Product. The use of The Product is restricted to end users who purchased a commercial edition of The Product and/or have received a free yet limited edition of The Product. If this does not apply to you, please return the complete program package to the dealer or reseller you acquired it from to obtain a refund or exchange.
Installing The Product constitutes acceptance of this license under applicable law, and upon opening this envelope or use of the material, you will be subject to the terms of this license. If you do not accept the terms of this license, do not install The Product.
The Product is copyrighted and is therefore protected by the Copyright Law of the United States and international treaty provisions. There are also patents pending on certain methods, processes and inventions contained in the Software Material and is protected by Patent Law. The effect of such laws and treaties is that you may not, without a license from TogetherSoft Corporation, copy or distribute The Product.
You are not to modify, adapt, translate, reverse engineer, decompile, or disassemble The Product. You may not distribute or transfer the software or copies to third parties You agree to notify your employees and agents who may have access to the software of the restrictions contained in this license agreement and to insure their compliance with these restrictions.
If this software is an upgrade of a version of The Product that you previously acquired, you have not acquired two different rights to use this software and its earlier version; this upgrade and the earlier version together constitute just one licensed copy of The Product.
THIS IS A SINGLE-COMPUTER LICENSE, that is to say, The Product may be installed on one computer at a time. However, this one license may be used on up to one additional computer, as a convenience to a user, provided that both computers are used by one user (not multiple users) and you only run one copy of the The Product at a time. If you purchase multiple licenses, you may deploy The Product on a server. However, the licenses are still per-computer licenses; one license must be purchased for each computer on the network from which The Product will be used.
LIMITED WARRANTY. TogetherSoft Corporation warrants only that the media and related documentation containing The Product delivered to its customer are free from defects in materials and workmanship for a period of sixty (60) days from the date of purchase. TogetherSoft Corporation's liability hereunder Is limited to an obligation to its customer to replace during the warranty any defective media containing The Product, which remedy shall be TogetherSoft Corporation's only obligation.
DISCLAIMER. EXCEPT AS EXPRESSLY STATED IN THIS AGREEMENT, THE SOFTWARE AND ANY DOCUMENTATION ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF PERFORMANCE OR MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. USER BEARS ALL RISK RELATING TO QUALITY AND PERFORMANCE OF THE SOFTWARE.
IN NO EVENT SHALL TOGETHERSOFT CPRPORATION. BE LIABLE ANY LOSS OF PROFIT OR ANY OTHER COMMERCIAL DAMAGE, INCLUDING BUT NOT LIMITED TO SPECIAL, INCIDENTAL CONSEQUENTIAL OR OTHER DAMAGES. TOGETHERSOFT CORPORATION. SPECIFICALLY DISCLAIMS ALL OTHER WARRANTIES EXPRESSED OR IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR USE OR PURPOSE RELATED TO DEFECTS IN THE PRODUCT.
GENERAL: This license contains the entire agreement between the parties with respect to The Product. This license is not assignable or otherwise transferable by the Customer without prior written consent of TogetherSoft Corporation.
